This End User License Agreement (“Agreement”) is a legal and binding agreement between you (an individual or a single entity) and Wittytool Software regarding the use of Wittytool software products, including but not limited to Wittytool Disk Clone and Wittytool Data Recovery, and any associated documentation.
By downloading, installing, copying, or otherwise using the software, you acknowledge that you have read this Agreement and agree to be bound by its terms. If you do not agree to these terms, do not install or use the software, and delete all copies in your possession immediately.
1. License Grant
Subject to your compliance with the terms of this Agreement, Wittytool grants you a personal, limited, revocable, non-transferable, and non-exclusive license to install and use the software on the number of devices specified by your purchased license type (e.g., Personal, Professional, Enterprise, or Technician Edition).
2. Software Specific Provisions
The following provisions apply to specific products within the Wittytool suite:
Wittytool Disk Clone: This software provides disk cloning, system migration, and backup capabilities. It features the ability to modify the System Identifier (SID) both during the cloning/migration process and as a standalone fix to resolve existing system conflicts. You are responsible for ensuring you have the legal right or explicit authorization to manage and modify the configurations of the target systems and data.
Wittytool Data Recovery: This software is designed to assist in recovering lost, formatted, or deleted data. Due to technical factors such as data overwriting or physical hardware failure, Wittytool cannot guarantee 100% recovery of all lost data. To maximize success, it is strongly recommended not to install the software on the same partition where data loss occurred.
3. License Restrictions
Unless expressly authorized in writing by Wittytool, you shall not:
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the software.
- Rent, lease, lend, distribute, transfer, or sublicense the software to any third party.
- Use the software to provide commercial hosting, time-sharing services, or any other service that exceeds the scope of your license (unless you have purchased a Technician or Enterprise edition with such rights).
- Modify or remove any copyright, trademark, or other proprietary notices contained in the software.
- Use the software for any illegal, infringing, or malicious activities.
4. Intellectual Property Rights
The software (including but not limited to its code, structure, design, graphics, text, and documentation) is the exclusive property of Wittytool Software and is protected by international intellectual property laws. This Agreement grants you the right to use the software but does not constitute a transfer of any ownership or intellectual property rights.
5. Privacy
Your use of the software is also governed by our Privacy Policy. We are committed to protecting user privacy and only collect information necessary for order processing, license verification, and technical support. We do not sell your personal data to third parties. Please refer to our official Privacy Policy page for more details.
6. Disclaimer of Warranties
The software and all accompanying materials are provided “AS IS” without warranty of any kind, either express or implied. Wittytool expressly disclaims all implied warranties, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Wittytool does not warrant that the software will be uninterrupted or error-free.
7. Limitation of Liability
To the maximum extent permitted by applicable law, Wittytool and its affiliates shall not be liable for any direct, indirect, special, incidental, or consequential damages (including data loss, business interruption, or loss of profits) arising out of the use or inability to use the software, even if Wittytool has been advised of the possibility of such damages. In no event shall Wittytool’s total liability exceed the actual amount paid by you for the software.
8. Termination
Wittytool reserves the right to terminate this license immediately if you fail to comply with any terms of this Agreement. Upon termination, you must stop using the software and destroy all copies of the software and its documentation in your possession or control. Sections regarding intellectual property, disclaimers, and limitations of liability shall survive the termination of this Agreement.
